  • a contractual or quasi-contractual relationship of trust (Art. 6 para. 1b GDPR)
  • a legal obligation (Art. 6 para. 1c GDPR)
  • consent (Art. 6 para. 1a GDPR)
  • legitimate interests of our company (Art. 6 (1f) GDPR), provided that the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest; legitimate interests are, for example, the proper functioning and security of our online offering.

2. Type, scope and purpose of collection, processing and use

Personal data is information that can be used to identify you as a person. This includes data such as names, contact details, but also photos, information about interests and hobbies or memberships as well as data recorded by the system, such as your IP address or the IP address of your internet provider.

Data collected by the system and protection of your privacy

We collect data about every access to our website in the form of server log files. This includes the name, date and time of the website accessed, file names, amount of data transferred, access status of the server (file transferred, file not found, command not executed, etc.), browser type and version as well as specific browser settings such as country or language feature, user's operating system, previously visited page (referrer), IP address, requesting provider, access method/function requested by the requesting computer (PC, mobile, remote access, etc.). We only use this log data for evaluations for the purpose of the operation, security and optimisation of our website. There is no personal reference and we do not endeavour to do so. However, we reserve the right to review the log data in detail in individual cases if there is a justified suspicion of unlawful use based on concrete evidence.

Enquiries

When you contact us, for example via contact form or e-mail, we store and use your data only within the scope of the stated business purpose or to process your enquiry.

Digital applications

On our website you have the opportunity to apply for a job in our company. For this purpose, we accept digital applications, regardless of whether you are applying for a position advertised by us or whether it is an unsolicited application. The separate data protection information for applicants can be found under this link.

Registration function

If you would like to use an application of our offer that is specially protected due to sensitive data, we require - in some cases legally prescribed - mandatory information for registration or to process your order. Contact forms follow the principle of data minimisation; mandatory fields are marked accordingly. Where your consent to the collection and use of your data is required, this will only be given after prior reference to the purpose of the processing and your associated rights, as well as verifiably and before you send your information. Data transmission is encrypted in accordance with current security standards.

Handling business partner data

The processing of business partner (contact) data generally involves data such as company address, telephone/fax and mobile phone number, e-mail address, tax number and, of course, non-personal data such as bank details or device and article-specific data and information regarding our business processes that are required in the course of proper business operations (offers, orders, order confirmations, delivery notes, invoices, etc.).

The purpose of data processing of business partner data in our company is the proper handling of our business relationships with information exchange, contact maintenance, project handling (commercial processes) and general correspondence as well as quality assurance in the form of an annual customer satisfaction survey (details below).

We would like to point out that, in addition to the data exchanged to date, we will also store corresponding information of the type described above in the future, as this is essential for business transactions. It will neither be used for other purposes nor made accessible to third parties and is protected accordingly by appropriate technical and organisational measures.

After the end of the contract, the data - documents subject to archiving upon expiry of the prescribed periods - will be effectively deleted or destroyed in both analogue and digital form in a timely manner. Your business data can be updated, supplemented or deleted (e.g. in the event of a change of contact person) to ensure the availability of the required data at any time by direct personal contact, by e-mail, by telephone or (as is currently the case) via a form.

Webinars & Seminars

We offer our business partners, interested parties and employees training programmes in the form of seminars, workshops and webinars. If you belong to one of our target groups, you will receive an invitation by e-mail in good time before the start of a specific event, together with the registration form or a link to register on our online webinar platform.
When you register for one of our webinars, we store and use the personal data you provide for online invitation management, including confirmation of participation, dial-in data and reminder e-mails. The invitation management and the webinars are carried out with the help of the cloud-based platform GoToWebinar from our carefully selected partner LogMeIn Inc, 320 Summer Street, Boston, MA 02210, USA. As the provider has a global presence, the data can be processed worldwide. For this reason, it provides particularly detailed information on data protection at www.logmeininc.com/de/legal/privacy. Webinars may be recorded with images and/or sound, provided that the participants and speaker have given their consent, in order to pass them on to the participants and any other interested parties. In addition, (anonymised or pseudonymised) evaluations in the form of registration, participant and customer satisfaction survey reports are carried out within the company for billing, quality assurance and to optimise our offer.

Customer satisfaction surveys

As part of our quality management programme, we are obliged to regularly survey and document the satisfaction of our customers with our services. To this end, if you belong to this target group, you will currently receive an annual e-mail with a link to our online form. We use the Lamapoll online platform of our carefully selected service provider Lamano GmbH & Co KG, Prenzlauer Allee 36G, 10405 Berlin, to collect and process the results. The provider provides data protection information here: https://www.lamapoll.de/Datenschutz-Sicherheit.

Data transfer

We process the data received for the purpose of optimising support for our users in cooperation with the relevant departments. In this way, we can save you unnecessary multiple contacts and provide you with exactly one contact person for your specific request, who will deal with your request competently in every respect. We will be happy to provide you with a list of the providers involved in our online services (data processors commissioned by us) on request. We do not pass on your data to third parties and of course do not sell it. Personal data is not processed outside the European Union (EU) or the European Economic Area (EEA), unless expressly described otherwise (e.g. Facebook).

Mobile use

We would like to point out that when using our website with mobile devices (e.g. mobile phones or tablets), precise location data may be collected, used and passed on for technical reasons, including the geographical location of your device. In addition, further data may be collected, processed and used in accordance with the terms of use of your respective telecommunications provider.

3. Procedures for the optimisation of our offer

It is generally possible to use our website without providing personal data. All of the following elements for range measurement and statistics on the behaviour of our users work at least with the pseudonymised form of your data, as we do not merge information on user behaviour with user profiles. In this way, even your IP address remains without personal reference.

Cookies

Our publicly accessible website can generally be used without cookies.
Cookies of different types are used on various pages of our website. These are very small text files that are stored on your computer. They do not cause any damage and do not contain any personal data about you. The device-related information stored in the cookies enables us to analyse the use of our website without personal reference and to recognise the device you are using on your next visit. This makes it easier for you to use our website (user-friendliness) and gives us the opportunity to optimise our offer for you. You can set your browser so that you are informed about the setting of cookies, decide whether to accept them on a case-by-case basis or generally exclude their acceptance. Further details on this can be found, for example, at https://www.aboutcookies.org.

Google Analytics & Search Console

Part of our offering (currently our job board) uses "Google Analytics" in conjunction with the "Google Search Console" application. We use these web analysis services of Google Inc, 1600 Amphitheatre, Pkwy, Mountain View, California 94043, USA ("Google") to optimise our website. Google has submitted to the EU-US Privacy Shield and has thus undertaken to comply with European data protection law. Google Analytics uses cookies to help the website analyse how users use the site. This information is usually transferred to a Google server in the USA and stored there. IP anonymisation is activated on our website so that the IP address of Google users within member states of the European Union or in other signatory states to the Agreement on the European Economic Area is truncated beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to analyse the use of the website by users, to compile reports on website activity and to provide other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. Search Console works without any personal reference.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. Users can also prevent Google from collecting the data generated by the cookie and relating to their use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available at the following link. The current link is:

http://tools.google.com/dlpage/gaoptout?hl=de<http://tools.google.com/dlpage/gaoptout?hl=de>

Further information on terms of use and data protection can be found at http://www.google.com/analytics/terms/de.html or at https://www.google.de/intl/de/policies/.

4. Additional applications of our offer (third parties & social media)

We round off our offer for you in part with links to carefully selected third-party providers. We cannot accept any responsibility for their content or data protection regulations. Third parties also receive your IP address for technical reasons. In your interest, we endeavour to only offer content whose providers only use the IP address to deliver the content. However, we have no influence over whether the third-party providers also store the IP address for statistical purposes, for example. If we become aware of this, we will inform you.

Use of social plug-ins or simple links

We offer you the opportunity to show your interest in our services on the social media platforms you use. To protect your privacy, we have dispensed with the popular "Like" buttons and instead offer you simple links to our pages, currently on the Facebook platform.

If you do not want social networks to assign the data collected via our website directly to your respective profile, please log out of the relevant social networks before visiting our website. You can also control or prevent the loading of plug-ins with appropriate add-on applications for your Internet browser, for example with a script blocker such as "NoScript" (https://noscript.net). Alternatively, you can use a browser that offers better control options by default (see section 2) for advanced users. If a user is not a member of the respective platform, there is still the possibility that the platform will find out their IP address and store it. Information on their data protection concept is therefore provided below.

Facebook

Our online offering uses social plug-ins ("plug-ins") from the social network facebook.com, which is operated by Facebook Inc, 1601 Willow Road, Menlo Park, CA 94205, USA ("Facebook"). According to Facebook, an anonymised IP address is only stored in Germany when the active button is used. We therefore use a simple link instead. Facebook provides its own data protection information at https://www.facebook.com/about/privacy/.

If you use our job exchange (http://www.logex-jobs.de) on Facebook, you transmit your data to the platform operator (Facebook). If you use the "Apply now" function, the Facebook system will suggest data that you have already entered in your profile in the form of an application form. This includes your user name, location, telephone number and e-mail address as well as details of your education and professional experience. You can change this information as you wish. You also have the option of being notified of new job offers. You can view and save your submitted application at any time under the function "Apply - To application" or in your message inbox on Facebook. The storage takes place exclusively with the operator Facebook. The information sent will also be sent to the responsible employee for further action. Tools with which you can control the access options to your data on Facebook are provided by the operator at https://www.facebook.com/privacy/.

Specific information on the use of cookies on Facebook and how you can control them can be found at
https://www.facebook.com/policies/cookies/.

5. Protection of your rights as a data subject (examples)

We have taken a variety of technical and organisational measures to adequately protect your data during processing. In doing so, we pursue the protection goals of confidentiality, integrity (completeness and accuracy of the data), availability and accountability (authenticity). Below are a few examples from our concept.

Data transmission from our own website will soon be encrypted in accordance with the latest security standards.

Access to our data processing systems takes place via a dedicated authorisation procedure that is checked regularly. Statistics on the use of our online services are either generated by the system or by our service providers; they also do not contain any personal references.

Logged data is generally analysed at least pseudonymously and exclusively by authorised employees who are obliged to comply with data protection regulations and are regularly trained and sensitised.

If business partners work on our behalf as part of data processing (outsourcing), they are carefully selected in accordance with the legal requirements and contractually bound to data protection. Compliance with the agreement is also checked on site if necessary.

You can revoke your consent to the storage of the data that you have provided to us at any time, provided that this is not required for the fulfilment of the contract or a correspondingly binding legal requirement (e.g. prescribed retention periods). You can send your cancellation informally with effect for the future to the controller named at the end of the document.

The duration of the storage of your data with regard to our online offer depends on the purpose for which it was transmitted and is in accordance with the legal requirements. It is also in our interest not to store your data in our systems for longer than is necessary. We determine the storage periods as part of the description of our processing activities; suitable technical rules and procedures are used to determine deletion periods and initiate the deletion of data that is no longer required, where technically possible.

As a user, you have the right to free information about the personal data stored about you. You also have the right to have incorrect data corrected, to restrict the use of your personal data or to have it deleted, provided that it is not required for the fulfilment of the contract and the deletion does not conflict with any legal obligation to retain it. You will not incur any costs for this other than the transmission costs according to the basic tariffs. The right to portability of your data does not currently apply to our online services, as we do not hold any suitable information about you. If you are of the opinion that our data processing does not comply with the legal requirements, we would be grateful if you could inform us accordingly. This does not affect your right to lodge a complaint with a supervisory authority.

To ensure the effectiveness and sustainability of implemented data protection measures, we are supported by proven external data protection experts as required.

If you call up pages and files of third parties within our offer and transmit data about yourself, we would like to point out that this data transmission via the Internet may be unsecured and the data could therefore be accessed by unauthorised persons.

Please note that we have no influence on the collection and use of your data when you visit or use our offers from third-party providers, e.g. our profiles on third-party platforms (e.g. Facebook as described above). This applies to all interaction options offered, such as leaving images/sound material or comments, unless these are expressly transmitted to our company in a way that is recognisable to you, e.g. by email. The data controller is the operator of the platform you visit and use. The data protection notices and declarations there apply.
